Bragg, Planning and Econ mic velopment Manager� <br /> Suzan Stickle,Planner S� <br /> SUBJECT: Request to vacate the 200 block of West Pythian Avenue and 55 feet between the 2500 <br /> and 2600 blocks of North Union Boulevard <br /> SUMMARY RECOMMENDATION: Staff recommends approval of the right-of-way vacation <br /> petition, subject to the following condition: <br /> 1. That a suitable turnaround, approved by the Department of Engineering and Infrastructure, <br /> be provided if access to Union Boulevard is terminated by the petitioner. <br /> The City Plan Commission voted 6-1-1 to recommend approval of this petition at the July 3, 2003 <br /> hearing; the minutes of the meeting are attached. The Commission requested that neighbors be <br /> notified of the vacation request. The petitioner has notified the Greater Decatur Y and St. John's <br /> Church of the vacation request. <br /> The public right-of-way does not appear necessary to serve the general public. Staff is of the opinion <br /> that the best interests of the City of Decatur would be served by approving the right-of-way vacation <br /> request. <br /> BACKGROUND: The subject petition requests the right-of-way vacation of the 200 block of West <br /> Pythian Avenue to allow for future development. <br /> The petitioner owns all property abutting the right-of-way to the north, south and west. The eastern <br /> portion of the right-of-way to be vacated abuts the Church Street right-of-way. The Council approved <br /> the North Union Boulevard Vacation between West Pythian Avenue and McKinley Avenue in June of <br /> 1999. <br /> An appraisal for the street vacation was submitted by the petitioner with an estimated market value of <br /> $8,000.00. A second appraisal was obtained by the City with an estimated market value of$9,200.00. <br /> The petitioner will pay the City of Decatur$9,200.00 for the vacation. <br /> There are utilities located at West Pythian Avenue; a permanent easement for utility maintenance will <br /> be maintained. <br /> POTENTIAL OBJECTION: There are no known objectors to this petition. <br /> STAFF REFERENCE: Any additional questions may be forwarded to Suzan Stickle at 424-2781 or <br /> at smstickle(�a,decaturnet.org. <br /> BUDGET/TIME IMPLICATIONS: None <br />
