Excerpts from Plan Commission Minutes of July 3, 2003 <br /> Calendar No. 03-30 Petition of Decatur Memorial Health Foundation, INC., 2300 <br /> North Edward Street,to vacate the 200 Block of West Pythian <br /> Avenue and fifty-five (55) feet between the 2500 and 2600 <br /> Blocks of North Union Boulevard. <br /> Ms. Suzan Stickle, Planner, was sworn in by Mrs. Althoff. <br /> Ms. Stickle presented the recommendation of staff: <br /> The petitioner is requesting the vacation of the 200 block of West Pythian Avenue to <br /> allow for future development in this area. <br /> The petitioner owns all property abutting the right-of-way to the north and south. The <br /> Greater Decatur Y owns the property abutting the western portion of the right-of-way to <br /> be vacated. The eastern portion of the right-of-way to be vacated abuts the Church Street <br /> right-of-way. The City Council approved the North Union Boulevard Vacation between <br /> West Pythian Avenue and McKinley Avenue in June of 1999. <br /> An appraisal for the street vacation was submitted by the petitioner with an estimated <br /> market value of$8,000.00. A second appraisal was obtained by the City with an <br /> estimated market value of$9,200.00. The petitioner will pay the City of Decatur <br /> $9,200.00 for the vacation. <br /> There are utilities located at West Pythian Avenue; a permanent easement for utility <br /> maintenance will be maintained. <br /> The public right-of-way does not appear necessary to serve the general public. Staff is of <br /> the opinion that the best interests of the City of Decatur would be served by approving <br /> the right-of-way vacation request. Staff recommends approval of the right-of-way <br /> vacation petition, subject to the following condition: <br /> 1. That a suitable turnaround, approved by the Department of Engineering and <br /> Infrastructure, be provided if access to Union Boulevard is terminated by the <br /> petitioner. <br /> Mr. Smith questioned if Union Street was vacated and how will people get access to the <br /> YMCA. <br /> Ms. Stickle answered yes, Union Street is vacated and there is another access to the <br /> YMCA. Union Street is vacated between McKinley and Pythian. <br /> Mr. Nordholm questioned if the YMCA and the Lutheran Church were notified of the <br /> vacation. Ms. Stickle stated no,they were not notified. Mr.Nordholm stated he was in I <br /> favor of tabling until both parties were notified and suggested posting signs on the <br /> proPerh'• I <br />
