Mr. John stated he agreed with Mr. Nordholm's comments, except for tabling the item. <br /> Mr. Phillip Cochran, Consulting Engineer, was sworn in by Mrs. Althoff. <br /> Mr. Phillip Cochran stated that the YMCA is on the Decatur Memorial Health <br /> Foundation's property. <br /> Mr. Cochran stated in 1999, a letter agreement was created between the Lutheran Church <br /> and the Foundation. Mr. Cochran stated the Church wrote a letter in favor of the <br /> agreement of the vacation of public right-of-way and the letter is on file. <br /> Mr. Cochran stated the foundation has owned the property and the vacation of right-of- <br /> way is very beneficial to the foundation as they plan on expansion. He stated that it has <br /> been discussed with staff and Engineering. He requested that it not be tabled. <br /> Mr. Nordholm questioned why the church was not notified of the change or why a sign <br /> was not posted. Mr. Cochran stated it was advertised in the paper. I <br /> Ms. Miller stated it was not required to post a sign at the site and the vacation was ' <br /> advertised. � <br /> Mr. Cochran stated that the south to north access will always be provided. <br /> Mr. Nordholm stated Pythian is used extensively for access. <br /> Mr. Smith questioned if there will be any problems with access for emergency vehicles. <br /> Mr. Cochran stated no and that it has already been reviewed by staff. <br /> Mr. Anderson stated he strongly recommends not to table and to go ahead and send to <br /> council. He requests that a stipulation be made to notify all neighbors before sending to <br /> council. <br /> Mr. Bragg reminded the Commission that a recommendation was not required to forward <br /> the item to City Council. <br /> Ms. Miller stated the petitioner owns all adjacent property,therefore no one else needs to <br /> be notified. <br /> Mr. Anderson stated the church should receive a letter. <br /> There were no objectors present. <br /> It was moved and seconded(Nordholm/Naber)to forward calendar No. 03-30 to Council <br /> with stipulation that staff notify neighbors of council meeting. Motion carried at a vote <br />
