Properties on <br /> the south side of West Main Street are zoned B-2 Commercial District (Salvation Army,West <br /> Main Liquor and St. Paul Church.) <br /> A Historic Neighborhood Use is allowed for properties within a historic district when the <br /> historical and architectural character of the building is preserved as well as the historic and <br /> architectural character of the surrounding neighborhood. Catholic Charities does not plan to <br /> change the exterior character of the building. Staff is uncertain that the retail use can preserve <br /> the historic and architectural character of the surrounding neighborhood <br /> The Historical and Architectural Sites Commission(HASC) reviewed the request at the May 21, <br /> 2003 meeting. HASC recommended approval of the petition for Historic Neighborhood Use <br /> with the conditions recommended by staff. Minutes are attached. <br /> Staff is concerned regarding the appropriateness and potential impact of retail uses on the <br /> surrounding neighborhood. At the direction of the City Council, staff recommends approval of <br /> the petition subject to the following conditions: <br /> 1. The hours of operation should be limited to 8:00 AM to 5:00 PM Monday through <br /> Friday. <br /> 2. There shall be no exterior drop off location or any outdoor storage area. <br /> 3. A site plan including a landscaping plan and a lighting plan shall be submitted to and <br /> approved by the Economic and Urban Development Department and the Engineering <br /> and Infrastructure Department. <br /> The Zoning Ordinance of the City of Decatur requires the Plan Commission to hold a public <br /> hearing on the rezoning request for study and a report on the effect of the proposed use on the <br /> comprehensive plan and on the character and development of the neighborhoodand make a <br /> recommendation to the City Council. In addition, Section XXII. C. 3. states that in evaluating a <br /> Historic Neighborhood Use, the Plan Commission must find that the proposed use and exterior <br />� appearance preserves the historic character of the building as well as the historic and architectural <br /> character of the surrounding neighborhood A recommendation of approval is suggested. <br /> Mr. Smith asked if City Council directed staff to approve the request and Ms. Miller stated that <br /> City Council did direct approval of this request. Mr. Smith asked if City Council directed staff <br /> to attach the stated conditions. Ms. Miller answered no, the conditions are part of the � <br /> Conditional Use Permit. <br /> Mrs. Sands asked if Catholic Charities no longer owned this property what could become of it. <br /> Ms. Miller stated that a similar use or an office use would be allowed or a petitioner could return <br /> for another historic neighborhood use.
