ORDINANCE NO. 2003-07 ORDINANCE AUTHORIZING EASEMENT ACQUISITION -JDN ADDITION - WHEREAS, the City of Decatur, Illinois, owns and operates a municipal sewerage system, as defined at 65 ILCS 5/11-141-1; and, WHEREAS, on November 24, 1998 the City approved the site plan for the commercial development of property located in the JDN Addition to the City of Decatur, the subdivision plat for said Addition being recorded at Book 1832 Page 757 of the records in the Recorder's Office of Macon County, Illinois, and a portion of said site plan being attached hereto as Exhibit A with said sewer being denoted in yellow thereon; and, WHEREAS, said site plan included the construction of a sanitary sewer to serve, in part, said commercial development, and also to be available for the use of other adjoining property owners, and which sanitary sewer was to be dedicated to the public and thereby become part of the City's municipal sewerage system, said sanitary sewer to be located in the following-described right-of-way: The North 225 feet of the East 15 feet and the North 25 feet of Lot 1 of B. Coombe 2nd Addition to the City of Decatur, as per Plat recorded in Book 1832, Page 293 of the records in the Recorder's Office of Macon County, Illinois (the "Premises"); and, WHEREAS, said sanitary sewer was constructed in the Premises but that no easement or other right-of-way in the Premises was dedicated to the City, and therefore said sanitary sewer is not a part of the City's municipal sewerage system as intended; and, WHEREAS, it is necessary and desirable that an easement or right-of-way in the Premises be acquired and that said sanitary sewer become part of the City's municipal sewerage system for the purpose aforesaid.
