NOW, THEREFORE, BE IT ORDAINED, BY THE CITY COUNCIL OF THE CITY <br /> OF DECATUR, ILLINOIS: <br /> Section 1. That it is, and it is hereby detennined to be, necessary and desirable that the <br /> City, in order that the sanitary sewer located in the Premises becomes a part of the City's <br /> municipal sewerage system, acquire an easement in, over and through the Premises for the <br /> purposes of the operation and maintenance of a sanitary sewer. <br /> Section 2. That it is hereby determined that an easement in, over and through the <br /> Premises for the purposes of the operation and maintenance of a sanitary sewer is necessary for a <br /> public use and purpose. <br /> Section 3. That the City Manager and the Corporation Counsel, jointly and severally, be, <br /> and they are hereby, authorized and directed to cause an easement in the Premises, for the <br /> purposes of operating and maintaining a sanitary sewer, to be acquired on behalf of the City, and <br /> in the event the same is not able to be acquired by agreement with the owner or owners thereof <br /> upon the compensation or consideration to be paid or furnished for the same, or in the event title <br /> thereto is defective, then title to and possession of such easement shall be acquired by and for the <br /> City by the exercise of eminent domain as provided in 735 ILCS 5/7-101 et seq. <br /> Section 4.
