� Excerpts from Plan Commission Minutes of November 7, 2002 <br /> Cal. No. 02-53 Petition of BRIAN and MELISSA McDERMITH for a Conditional Use <br /> Permit at 475 EAST WABASH to operate an Automotive Storage Yard. <br /> Mrs. Stewart presented the recommendation of staff: <br /> The subject property contains a 17,880 (120' x 149') square foot lot with an aluminum storage <br /> shed and is currently being used for the storage of repossessed automobiles by the owners of B <br /> and M Recovery. The subject petitioners are requesting a Conditional Use Permit to bring the <br /> property into compliance with the City's Zoning Ordinance. <br /> The area in question as well as the properties to the south, east and west are presently zmed M-2, <br /> Heavy Industrial District with similar land uses. Property to the north is zoned M-1 <br /> Intense-Commercial-Light Industrial District and accordingly developed. <br /> According to the property owners all vehicles are constantly moved and no vehicles will be left <br /> on the property for more than 30 days. The property is secured by an eight(8)foot fence with <br /> flood lights. Access for this business will be off of Wabash Avenue. <br /> Section XXII.A.3 lists three (3)standards which must be met in order to grant a Conditional Use <br /> Permit. <br /> The first standard requires the applicant to show that the use is "necessary for the public <br /> convenience at that location." The proposed use is generally compatible with the neighborhood <br /> and is in a location that does not negatively impact surrounding properties in the required M-2 <br /> District. <br /> The proposed use also meets the second standard. The facility is located and designed to be <br /> operated in a manner that the public health, safety and welfare will be protected. <br /> This use also meets the third standard. The facility has not and will not cause substantial injury , <br /> to the value of other properties in the neighborhood. The storage yard will be required to meet I <br /> all applicable City building and fire codes. ', <br /> The Building Inspections Manager and the Fire Marshall have both reviewed the proposal and II� <br /> inspected the site and find it acceptable. <br /> Based on the above analysis, staff recommends approval of the petition as submitted with the <br /> following stipulations: <br /> a. The storage area must be wholly enclosed by a sight break fence of not less than eight(8) <br /> feet in height in which the opening or cracks are not more than 15 percent of the total <br /> area; <br />
