Access would be accomplished via two new commercial curb cuts - one located along North
' Main Street and one located immediately west of the center median on West Garfield
Avenue.
4. The petitioner proposes to capture storm water from the development in a surface detention
swale located at the north end of the property. The detention area outlets to the City sewer at
Garfield and North Main.
5. The petitioner proposes to vary the required rear yard setback from 25 feet to 16 feet in order
to accommodate the proposed building. The required buffer yard area and landscaping will
be retained as per the requirements of the Zoning Ordinance.
6. A Conditional Use Permit is required in order to accommodate a structure larger than 6,000
square feet in the B-1 Neighborhood Shopping District.
STAFF ANALYSIS
7. The City of Decatur Zoning Ordinance provides standards for reviewing conditional use
permits. The standards are described as follows:
a. Necessary for the public convenience at that location.
b. Is so designated, located and proposed to be operated that the public health, safety and
welfare will be protected.
c. Will not cause substantial injury to the value of other property in the neighborhood in
which it is to be located.
8. The proposed use of property is consistent with an office/service business use and will not
threaten the value of surrounding properties. Furthermore, the development will make use of
property that is not desirable for residential use.
9. The proposed landscaping plan meets the requirements of the City of Decatur Zoning
Ordinance and provides necessary front yard, buffer yard, parking lot and activity area
landscaping. In addition, the petitioner has attempted to save existing mature vegetation
where possible.
10. The property is shown on the Urban Corridors Plan proposed land use map as Mixed Use:
Urban Redevelopment. The proposed office/service use fits into the land use plan by creating
an adequate buffer between the residential area to the west and the Main Street corridor.
Furthermore, the proposed development will be of a scale appropriate to the neighborhood.
STAFF RECOMMENDATION
11. Staff finds the proposed use to be consistent with the goals of the Decatur Urban Area Land
Use Plan and the Urban Corridors Plan. Further, staff believes that the proposed
development will enhance the area. Based on the above analysis, staff recommends approval
of the petition as submitted.
