No. 02-49 Petition of MARY McCUMBER for a Conditional Use Permit at 1315 <br /> NORTH GULICK AVENUE to operate a licensed large home daycare <br /> facility. <br /> Mrs. Stewart presented the recommendation of staff: <br /> The subject petition requests a conditional use permit to allow the operation of a licensed large <br /> home daycare facility. The daycare would accommodate a maximum of twelve children. <br /> The petitioner's drop off and pick up area will be in front of her house along North Gulick. The <br /> petitioner intends to request a drop off area from the Parking and Traffic Commission. The <br /> entire rear yard is fenced except the area between the house and the garage. The petitioner <br /> proposes to install a fence with a gate at this location. The petitionerproposes to open her <br /> daycare facility in January 2003. <br /> Upon review of land use and zoning patterns of the general area, staff notes that while the tract is <br /> surrounded by property zoned R-3, Single Family with existing dwellings on three sides, <br /> property to the west across the alley is zoned B-1 Neighborhood Shopping District and <br /> accordingly developed. <br /> Section XXII.A.3lists three standards which must be met in order to grant a conditional use <br /> permit. The first standard requires the applicant to show that the use is "necessary for the public <br /> convenience at that location." The proposed use is generally compatible with the neighborhood <br /> and provides a service which can be utilized by area residents. <br /> The proposed use also meets the second standard. The facility is located and designed to be <br /> operated in a manner that the public health, safety and welfare will be protected. <br /> This use also meets the third standard, the facility has not and will not cause substantial injury to <br /> the value of other properties in the neighborhood. The day care use will be required to meet all <br /> applicable City building and fire codes, as well as all requirements imposed by the State in the <br /> issuance of a home day care license. <br /> Based on the above analysis, staff recommends approval of the petition as submitted with the <br /> following stipulations: <br /> (a.)That the proposed operation be limited to a maximum of twelve children, <br /> (b.)A drop-off/pick-up area will be required along North Gulick, <br /> (c.)That the proposed operation be in compliance with applicable provisions of the City's <br /> adopted Building Codes, including obtaining a building permit to perform any proposed <br /> or required improvements to the existing dwelling, <br /> (d.)That the proposed daycare be at all times appropriately licensed by the State of Illinois <br /> and a copy of that license,upon approval,will need to be filed with the Economic and <br /> Urban Development Department, <br />
