[.3f1 _.1 � � � �l3 � t � �� CJ� V Ffiereb �o��, � Certify Th�t Thic in�trument Was KNRd I�or , �, R�cor:.i�c 12:05 PM 1G�i��'�i1. . ___ _..�.,.�.,.�., ORDINANCE NO. 2002-91 �� ' �� R 3267 812 ecordea in B�ok,�,Pa�e�—� Q .� Fee 22•� Recorder AN ORDINANCE VACATING RIGHT OF WAY - HAYS AVENUE BETWEEN CHARLES AND WOODFORD STREETS - WHEREAS, a request has been received from Waks Inveshnents, L.L.C. requesting vacation by the City Council of right of way located on Hays Avenue between North Charles and North Woodford Streets, said right of way being more particularly described as follows: A parcel of land being a part of the Northeast Quarter of Section Thirty-five (35), Township Seventeen (17) North, Range Two (2) East of the Third Principal Meridian in Macon County, Illinois; more particularly described as: Commencing at a stone at the Southeast corner of the Northeast Quarter of Said Section 35, thence Westerly along the South line of the Northeast Quarter of said Section 35 for a distance of 40.01 feet; thence Northerly 50.02 feet to the point of beginning, said point being the intersection of the Westerly Right Of Way line of North Woodford Street and a point 50.02 feet North of the South line of the Northeast Quarter of said Section 35; thence Westerly 598.81 feet on the South right of way line of proposed Hays Avenue to a point, said point being on the Easterly Right Of Way of North Charles Street extended North; thence Northerly 50 feet along the East Right Of Way line of Charles Street extended to a point on the North Right Of Way line of proposed Hays Avenue; thence Easterly 598.75 feet on the North Right Of Way line of proposed Hays Avenue to a point on the Westerly Right Of Way of North Woodford Street; thence Southerly 50 feet to the point of beginning and containing 0.687 acres more or less; and, WHEREAS, said right of way is no longer useful to the public or to the City; and, WHEREAS, the public interest will be subserved by vacating said right of way and the public will be relieved from any further burden or responsibility for maintaining said right of way.
