, ' ��t � � � � <br /> � PGB I .� <br />, NOW, THEREFORE, BE IT ORDAINED, BY THE CITY COUNCIL OF THE CITY <br /> OF DECATUR, ILLINOIS: <br /> Section 1. That the above described right of way be, and the same is hereby, vacated as <br /> right of way inasmuch as the same is no longer required for public use and the public interest <br /> will be subserved by such vacation, said right of way being shown on the plat thereof hereto <br /> attached and hereby made a part hereof. <br /> Section 2. That the benefits which will be accrued to the owner of abutting property by <br /> reason of the vacation aforesaid is determined to be, in the judgment of the Council, equal to the <br /> sum of Four Thousand Five Hundred Dollars ($4,500.00). <br /> Section 3. That the vacation herein provided for is made upon the express condition that <br /> there shall be paid to the City of Decatur, Illinois, by or on behalf Waks Investments, L.L.C., of <br /> the owner of property abutting that right of way vacated hereby the sum of $4,500.00 as <br /> compensation for the benefits determined as above set out herein upon the payment whereof such <br /> vacation shall become effecrive and title to said vacated right of way shall be vested in Waks <br /> Investments, L.L.C. as provided by law. <br /> PRESENTED, PASSED, APPROVED AND RECORDED this 21st day of October, <br /> 2002. <br /> TERRY M.
