No. 02-41 Petition of DEBORAH N.WARNICK for a Conditional Use Permit ', <br /> (Historic Neighbarhood Use) at 623 WEST MAIN STREET to operate � <br /> a real estate office. , <br /> Ms. Miller presented the recommendation of staff: ! <br /> The petitioner is requesting a Conditional Use Permit to allow an office as a Historic �I <br /> Neighborhood use at 623 West Main Street; the premises are currently zoned R-6 Multiple , <br />' Dwelling District. The home will be used as the offices for Heritage Homes. Approximately � <br /> 1100 square feet of gross floor area will be used as the real estate office. I, <br /> The Zoning Ordinance provides for a historic neighborhood use in any zone located within the �' <br /> Decatur Historic District providing such use preserves the historic, architectural and residential <br /> character of the structure. Such use must preserve the essential character and nature of the <br /> surrounding neighborhood as well. Plans submitted shall be in compliance with the Zoning <br /> Ordinance and prior to occupancy, the building shall be in compliance with the City Building <br /> Codes. <br /> The proposed office use meets the applicable criteria for a historic neighborhood use. (The <br /> structure at 623 West Main Street is within the boundaries of the local historic district and <br /> requires plan review and an approved certificate before changes are made to the structure.) The <br /> office use will not be intrusive to the residential character of the neighborhood. It appears that <br /> the change in use to office at this location will meet the building and accessibility codes. <br /> Adequate parking for the 1132 square feet of office space (four(4) spaces)will be provided on <br /> the site. A one-way access drive will be provided from West Main Street to the paved alley. The <br /> existing landscaping meets the requirements of the Zoning Ordinance <br /> The proposed use was reviewed by the Historical and Architectural Sites Commission on August <br /> 21 with a recommendation of approval. The certificates of appropriateness for installation of a <br /> handicapped ramp in the rear of the building and signage in the front window were also approved <br /> pending the approval of the special use permit. <br /> Staff recommends approval of the proposed historic neighborhood use provided that(1)the <br /> proposed development occurs in accordance with the data and site plan submitted by the <br /> petitioner, that the site plan be submitted to and approved by the Economic and Urban <br /> Development Department and the Engineering and Infrastructure Department and (3) that prior <br /> to the issuance of a Certificate of Occupancy, the building be in compliance with the City's <br /> Building Codes. <br /> Mr. John stated that it looked like the zoning and Comprehensive Plan information was for the <br /> block east of Monroe and this is actually the block west of Monroe. He requested that a zoning <br /> map of the area be included in the packet as it is useful information. <br />
