Excerpts from Plan Commission Minutes of September 5, 2002 <br /> Cal. No. 02-40 Petition of ROBERTSON CHARTER SCHOOL to rezone the <br /> property located at 1424-1454 EAST NORTH STREET from O-1 Office <br /> District and M-3 Industrial District to PD Planned Development District <br /> in order to facilitate a mixed use development that includes the charter <br /> school. <br /> Ms. Miller presented the recommendation of staff: <br /> The petitioner is requesting the rezoning of the East North Street site to PD in order to expand <br /> the Charter School and maintain a mixed use development. During the last year, the Charter <br /> School operated from the building on the west portion of the site that is zoned O-1, Office <br /> District. The school is adding another grade this year and has constructed classrooms in the <br /> building across the parking lot that is zoned M-3 Limited Industrial District. The Zoning <br /> Ordinance does not allow Public School uses in Industrial Zoning. It is planned that the existing � <br /> automobile paint shop will remain at the site along with the possibility of an additional retail use. , <br />', The site must be rezoned to Planned Development District to allow multiple land uses on the ; <br /> same site. �'� <br /> Approximately 7570 square feet of the building space will be used by the diarter school; 3100 <br /> square feet is available for retail space and 3100 square feet will be used for the paint store on the <br /> 1.1 acre site. <br /> Ingress to the site is from East North Street while egress is to the paved alley at the north of the <br /> site. Adequate parking is provided on the site for all of the proposed uses. Classroom use <br /> requires less parking than retail use so that if the school is expanded, adequate parking will still <br /> be available. <br /> No elevation drawings were submitted since the site is existing and no changes are proposed to <br /> the exterior of the building. A landscaping plan has been submitted meeting the requirements of <br /> the Zoning Ordinance. <br /> The proposed mixed-use development(consisting of the school, the paint shop and retail space) <br /> is compatible with the character of the surrounding area. The existing streets and existing <br /> utilities are adequate to serve the site. Existing sidewalks along East North Street and North East <br /> Street serve the site. The bus loading zone is located on East North Street. <br /> Staff feels the petition meets the requirements of the ordinance and recommends approval of the <br /> petition to rezone the property to PD, Planned Development District. <br /> The Zoning Ordinance of the City of Decatur requires that petitions for the Planned Development <br /> District be submitted to the Plan Commission for public hearing, study and report concerning the <br /> effect of the proposed use on the comprehensive plan and compliance with ordinance standards. <br /> A motion to forward the request of Cal. No. 02�0 to the City Council with a recommendation of <br /> approval is suggested. <br />
