Excerpts from City Plan Commission Minutes of August 1, 2002 <br /> Cal. No. 02-36 Petition of JAMES and KATHRYN GRESHAM to vacate a portion of <br /> the alley at 129 SOUTH OAKLAND AVENUE. <br />, Ms. Miller presented the recommendation of staff: <br /> The petitioner wishes to vacate all of the fourteen(14) foot alley way located south of Lock <br /> Stock and Barrel. The etitioner owns the ro erty on both sides of the alley. They wish to <br /> P P P <br /> vacate the alley to provide an outside area for dining. The alley will be gated to restrict access. <br /> Utility access will be from the existing parking lot. <br /> An appraisal for the proposed alley vacation was obtained by the petitioner with an estimated <br /> market value of$500. The petitioner will pay the City $500 for the property to be vacated. <br /> Utility letters have been received from Illinois Power and Insight Communications stating <br /> agreement with the vacation and requesting that ingress and egress easements be reserved for <br /> utility maintenance. <br /> Since the public right of way does not appear necessary to serve the general public; staff is of the <br /> opinion that the best interests of the City of Decatur would be served by approving the alley <br /> vacation and reserving an easement for utility maintenance. Staff recommends approval of the <br /> petition. <br /> The Administrative Policy of the City of Decatur requires that property vacation requests be <br /> submitted for a public hearing. Although a Plan Commission recommendation is not required, a <br /> motion to forward the request of Cal. No. 02-36 to the City Council with a recommendation of <br /> approval is suggested. <br /> Jim and Kathy Gresham, owners of Lock Stock and Barrel,were present. <br /> There were no objectors present. <br /> It was moved and seconded(Peck/Oakes)to forward Cal. No. 02-36 to City Council with <br /> recommendation for approval. Motion carried. Commissoner Clevenger was not present at the <br /> vote. <br />
