Mil er, AICP, Planner�(� r <br /> ��. .r <br /> SUBJECT: Alley Way Vacation-- 129 South Oakland Avenue <br /> SUMMARY RECOMMENDATION: Staff recommends approval of the alley vacation. Since <br /> the public right of way does not appear necessary to serve the general public, staff is of the <br /> opinion that the best interests of the City of Decatur would be served by approving the alley <br /> vacation and reserving an easement for utility maintenance. The Plan Commission reviewed the <br /> request at the August 1, 2002 meeting and recommended approval with a vote of 9 to 0. Plan <br /> Commission minutes are attached. <br /> BACKGROUND: The petitioner wishes to vacate all of the fourteen (14) foot alley way located <br /> south of Lock Stock and Barrel to provide an outside area for dining. The petitioner owns the <br /> property on both sides of the alley. The alley will be gated to restrict access. Utility access will <br /> be from the existing parking lot. If approved the existing approach will be replaced by a <br /> landscaped island. Sidewalks are currently being replaced at Wood Street and Oakland Avenue. <br /> POTENTIAL OBJECTIONS: There were no objectors to the alley vacation at the Plan <br /> Commission meeting. <br /> INPUT FROM OTHER SOURCES: Utility letters have been received: an easement for utility <br /> access and maintenance will be required. <br /> STAFF REFERENCES: If Council members have questions they may contact Kathy Miller at <br /> 424-2786 or at kjmiller@decaturnet.org. <br /> BUDGET/TIME IMPLICATIONS: An appraisal for the area to be vacated was submitted with <br /> an estimated market value of$500. The petitioner will pay the City $500 for the property to be <br /> vacated. <br />
