past 10 years, whichever is most recent, may retain their license so long as they are not convicted
of any other felony from this date forward.
2. Any person referred to in paragraph one (1) above, who furnishes any false information
on their application will result in automatic revocation of their license to drive a taxicab in the
City of Decatur and any further application for a taxicab driver's license shall be denied.
3. Commencing on the date of enactment of these amendments to the ordinance, no person
convicted of a felony under ILCS or similar statutes in another jurisdiction, shall be granted a
taxicab driver's license in the City of Decatur.
4. No other person who has knowingly furnished false or misleading information or withheld
relevant informatian on such appldcation or caused or permitted another to furnish or withhold
such information on his or her behalf in their application for a taxicab driver's license, shall be
granted a taxicab driver's license.
S. No person who is required to register as a sex offender under the laws of this state and no
person convicted of an offense in any other jurisdiction that would require them to so register had
the o,f,`'ense occurred in Illinois, or any person ever adjudicated as a sexually dangerous person
may be granted a taxicab driver's license.
Again, I must advise council that I am not in favor of the suggested compromise, I only propose it because I
am concerned that the current wording of Chapter 60 is in jeopardy due to the objection of 11 convicted
felons cunently licensed as taxicab drivers by the City of Decatur.
I would point out to council that there was, and is, a good reason for our ordinances requiring the Chief of
Police to approve taxicab driver's licenses. There are only two other types of licenses so required in the
City of Decatur. One is raile licenses and the other is transient merchant licenses. In each of the three
cases, this requirement is in place so that the Chief of Police assumes(rightfully so)full responsibility for
the legitimacy of those individuals so licensed. The citizens of this community depend upon their protectors
to insure their safety and security. When legislation is enacted in contradiction to what the Chief of Police
recommends, the trust and confidence held by the public for their police officials is in danger of
compromise. The council has been very reliant upon, and respectful towards, my opinions and years of
experience in policing this City in previous matters. I would ask that the same trust be applied to this issue.
POTENTIAL OBJECTION: As this matter, much to my surprise, has generated more public interest,
involvement and ire than any I can recall in recent years, I am sure there will be some objection.
STAFF REFERENCE:
Mark Barthelemy, Chief of Police, telephone 424-2741
E-mail mark.barthelemy@decaturnet.org
Attending the meeting will be
