, � <br /> ORDINANCE NO. 2002-39 <br /> ORDINANCE GRANTING SPECIAL PERMIT <br /> COMMUNICATION TOWER <br /> - SPECTRASITE COMMUNICATIONS - <br /> WHEREAS, on the 2nd day of May, 2002, upon due notice, the Decatur City Plan <br /> Commission held a public hearing upon the petition of SpectraSite Communications, Inc. for <br /> a special permit under the provisions of Section XXI(A)(1)(j) of the Zoning Ordinance to <br /> construct, operate and maintain a freestanding communication tower and equipment building, on <br /> property located in the City of Decatur, Illinois and legally described as follows: <br /> A parcel of land being a part of the Southwest Quarter of the Southeast Quarter of <br /> Section 9, Township 16 North, Range 2 East of the Third Principal Meridian. <br /> Said parcel is part of property described and Recorded in Book 2995, Page 859 in <br /> the Macon County Court House in the Name of Fairview Park Plaza, LLC, dated <br /> August 31, 2000. Said parcel being more particularly described as follows: <br /> Beginning at a `PK' nail set at the Southwest corner of said parcel being located <br /> North 89°48'S7" West, 1142.75 feet from an iron rod found at the intersection of <br /> the North right-of-way line of the Norfolk and Southern Railroad (Formerly <br /> Wabash Railroad) with the present west right-of-way line of S.B.I. Route 48 <br /> (Fairview Avenue). Thence along new lines the following four (4) calls thence, <br /> North 00°15'34" West, 30.00 feet to the Northwest corner of said parcel thence, <br /> North 89°44'26" East, 50.00 feet to the Northeast corner of said parcel. Thence, <br /> South 00°15'34" East, 30.00 feet to the Southeast corner of said parcel thence, <br /> South 89°44'26"West, 50.00 feet to the point of beginning; and, <br /> WHEREAS, said Decatur City Plan Commission recommended that such special permit <br /> be denied. <br />
