2002-39 GRANTING SPECIAL PERMIT COMMUNICATION TOWER - SPECTRASITE COMMUNICATIONS

NOW, THEREFORE, BE IT ORDAINED, BY THE CITY COUNCIL OF THE CITY OF DECATUR, ILLINOIS: Section 1. That the recommendation and report of the Decatur City Plan Commission be, and the same are hereby,received, placed on file and disapproved. Section 2. That upon the conditions hereinafter mentioned, a special perniit be, and it is hereby, granted to SpectraSite Communications, Inc., and only to SpectraSite Communications, Inc. to construct, operate and maintain a freestanding 180-foot high monopole type communication tower and equipment building upon the premises aforesaid in accordance with the plat thereof hereto attached marked Exhibit A and hereby made a part hereof. Section 3. That said permit be, and the same is hereby, expressly conditioned as follows: (a) That said communication tower be a monopole structure. (b) That prior to construction, complete building and construction plans shall be submitted to and approved by the Department of Community Development and the Department of Engineering&Infrastructure, and a building permit shall be obtained. (c) That upon completion of construction, all ladder rungs attached to the subject tower shall be removed a minimum distance of forty (40) feet above ground level, and further that as such rungs may be installed for future maintenance they shall be removed upon completion of the work. (d) That a ten (10) foot high chain link fence shall be constructed around the base of said tower. Section 4. That said special use permit granted hereby, be, and it is hereby, made subject to the applicable provisions and requirements of Ordinance No. 3512, the same being the Zoning Ordinance of the City of Decatur, Illinois, and that the Zoning Map of said City be amended to show the granting and existence of this special use permit.
