Miller, AICP,Planner ��� <br /> SUBJECT: Right of Way Vacation-- 1600 Block South West Gate Drive <br /> SUMMARY RECOMMENDATION: Staff recommends approval of the alley vacation. The <br /> Plan Commission reviewed the request at the February 7, 2002 meeting and recommended <br /> approval with a vote of 9 to 0. Plan Commission minutes are attached. <br /> BACKGROUND: The West Gate Drive right of way was dedicated when the Hall and Bray <br /> Addition was platted. The road was never constructed at this location and there are no current <br /> plans to construct the road north of Ridgeview Drive. Although the subject property is adjacent <br /> to Conservation District property, the Conservation District and the Park District have no plans <br /> for trail or bikeway access at this location. The petitioners would like to vacate the right of way <br /> and split the property. <br /> POTENTIAL OBJECTIONS: There were no objectors to the alley vacation at the Plan <br /> Commission meeting. <br /> INPUT FROM OTHER SOURCES: Utility letters have been received: an easement for utility <br /> access and maintenance will be required. <br /> STAFF REFERENCES: If Council members have questions they may contact Kathy Miller at <br /> 424-2786 or at kjmiller@decaturnet.org. <br /> BUDGET/TIME IMPLICATIONS: An appraisal for the area to be vacated was submitted with <br /> an estimated market value of $2500. A second appraisal was submitted to the City of$3000. <br /> The petitioner will pay the City$3000 for the vacated right of way. <br />
