Decatur City Plan Comrnission
January 3, 2002
Page Five
petitioner intends to create a carnpus-like setting with the condominiums, assisted living facility
and nursing home. It is possible that a person could move from one facility to the other and
remain in the same area. There is R-5 zoning across the street so the proposed development
would not be spot zoning. Mr. Van Steenhuyse stated that this is an assisted living facility and
not a health care facility. It is not a full time medical facility.
Mrs. Sands asked if there was a definition for assisted living facility. Mr. Van Steenhuyse stated
that there was not one in the Zoning Ordinance.
Ms. Miller stated that the units would be more like apartments and this would not be a residential
care facility. Mr. Van Steenhuyse stated that an R-6 zoning would allow a much more dense
development.
Mr. Schiller stated that the R-5 zoning provides more protection for the neighborhood. In
response to questions, Mr. Schiller stated that the land use map is used as a reference but the
Commission is not legally bound by it. The existing map is ten years old and in the process of
being updated.
Mrs. Hott asked where the determination of a Planned Unit Development is written. Mr. Van
Steenhuyse stated that it is in the Special Use section of the Zoning Ordinance.
Mrs. Hott asked how the zoning could go from allowing a duplex to 48 units. Mr. Van ',
Steenhuyse stated that the Planned Unit Development allows flexibility with the numbers and II
noted that a residential Planned Unit Development could have commercial uses and vice versa. 'I
Mrs. Sands asked if Mrs. Hott would still object if there were a larger sight break. Mrs. Hott I'
stated that she would still object since there will be more nose and more traffic which would
take away her privacy.
Mr. Shampine asked how many structures in t v area were single family and one story. Mr. Hott
stated that the structures represented on the pe ition of objection were all one story except the old
Imboden house which is two houses south of Imboden Drive. Mr. Hott stated that he was also
representing the neighbors that could not attend today's meeting.
Mr. Shampine asked what the primary objection was. Mr. Hott stated that the character of the
neighborhood is not a 40,000 square foot building.
tem t was made to work with the to o ra h of the ro ert and
Mr. Gavin stated that ever at p g P Y P P Y
Y P
the owner is willing to work with the neighbors on the barrier.
Mrs. Sands asked why more landscaping was not provided on the south side. Mr. DesCarpentrie
stated that as many existing trees and vegetation would be kept as possible. If evergreens were
planted to grow properly some of the existing vegetation would have to be removed.
