No. 01-45 Petition of FINLAY INTERESTS 3, LTD., Jacksonville Beach, Florida <br /> to vacate a portion of the alley located south of and parallel to the 700 <br /> Block of West Grand Avenue. <br /> Mr. Van Steenhuyse presented the recommendation of staff: <br /> This item was tabled at the November 1 Plan Commission meeting. The subject property consists ', <br /> of a 16-foot wide public alley that currently extends east from Pine Street 200 feet. The alley was ' <br /> originally platted all the way between Pine and Monroe, but the remainder was vacated by <br /> District 61 as the Roosevelt Middle School and grounds were developed. The alley is located <br /> within the area approved as a Residential Development Plan for the Roosevelt School <br /> Apartments. This plan was approved by the Council in March of 2001 and amended in August. <br /> When the site plan for this project was submitted in October, it was discovered that a portion of <br /> the parking area for the apartment project would be located on the public alley. Although the <br /> plan shows no buildings on the alley, it was deemed in the best interest of both the City and the <br /> project to file a request for vacation of the right-of-way. <br /> Only the east 120 feet of the existing alley is proposed to be vacated. The west 80 feet off of Pine <br /> will continue to provide access to the two privately-owned lots on the north and south sides of <br /> the alley with frontage on Pine. The plan shows that some parking spaces, a portion of a sidewalk <br /> and a portion of a landscape area will be located upon the area proposed to be vacated. No <br /> _ construction has taken place on the un-vacated right-of-way. The developer has been informed <br /> that no construction will be permitted prior to final approval and filing of the alley vacation. <br /> The City has received an appraisal of the alley in the amount of$500.00 fromFitzganald and <br /> Associates. In addition, the three public utilities(Ameritech/SBC,Insight Communications and <br /> Illinois Power) have submitted letters of no objection, subject to maintaining easements for <br /> existing equipment within the right-of-way. . <br /> The portion of the alley proposed to be vacated no longer serves a public purpose. The <br /> maintenance of the west 80 feet will protect the access rights of the properties along Pine Street. . <br /> Mrs. Washington asked if the other two properties would be rezoned by the development. Mr. <br /> Van Steenhuyse answered no and that they are single family homes. Mrs. Washington asked if <br /> the 80 feet would be rnaintained by the City and Mr. Van Steenhuyse stated that it would be. <br /> There was no one present to speak in favor of the petition. <br /> There were no objectors present. <br /> It was moved and seconded (John/Peck) to forward Cal. No. 01-45 to City Council with <br /> recommendation for approval. Motion carried with Mrs. Washington voting nay. Mr.Clevenger <br /> was not present during the vote. <br />
