Cal. No. 01-50 Petition of A.J. KRIEGER,Assistant City Manager, to rezone the <br /> premises located at 704 WEST LEAFLAND AVENUE from R-5 <br /> Two Family Residence District to R-6 Multiple Dwelling District. <br /> Mr. Van Steenhuyse presented the recommendation of staff: <br /> The subject property is part of the Roosevelt School Apartments Residential Development Plan <br /> (RDP) approved by the City Council on March 1, 2001 and amended in August. All of the <br /> properties included in the RDP were believed to have been rezoned under separate action by the <br /> City Council on February 19. However, the original petition for rezoning of these properties did <br /> not include the property in question. At the time of the original petition, the developers did not <br /> own the subject property. During the RDP approval process, they acquired the property and <br /> included it in the RDP eventually approved by Council. However, they failed to submit a petition <br /> to rezone the property. This was discovered later, as a result of due diligence by a potential <br /> lender. <br /> This action rezones the property on Leafland to R-6 and brings it into conformance with the <br /> approved Roosevelt School RDP. <br /> No construction has occurred upon this property, and it has not been used in any manner <br /> inconsistent with its current zoning. Rezoning of the property makes its zoning consistent with <br /> ,. the surrounding properties. <br /> Staff recommends approval of the petition to rezone 704 West Leafland from R-5 to R-6. <br /> There were no objectors present. <br /> It was moved and seconded (Smith/Sands) to forward Cal. No. 01-50 to City Council with <br /> recommendation for approval. Motion carried with a nay vote by Commissioner Washington. <br />
