The alley to the east of the current request (for 205 feet)was I
vacated in June, 1987.
The petitioner wishes to vacate the remaining portion of the a11ey just east of Oakland Avenue for
commercial development. A ten inch sewer line located !
in the alley will also be relocated. Insight communication has no cable television line in the alley !
right of way. '
This public right of way does not appeax necessary to serve the general public; staff is of the
opinion that the best interests of the City of Decatur would be served by approving the alley
vacation request. Staff recommends approval of the alley vacation. '
Mr. John noted that the foundation has already been poured across the alley and petitioner has
proceeded without approval. Mr. Van Steenhuyse stated that the vacation petition is a formality
although the petition had to be in place as a condition for issuance of a building permit. Petitioner
owns all of the property around the alley.
Mr. Shampine stated that he felt staff had reviewed the request and there was no violation. Mr.
John stated that he is in complete support of the project but the vacation process should occur
beforehand.
Mr. Phillip Cochran was present to represent the petitioner and he stated that there was a note
regarding the vacation of the alley on the Planned Unit Development drawing submitted in
December of 2000.
There were no objectors present.
It was moved and seconded (Smith/Schiller)to forwaxd Cal.
