WHEREAS, the public interest will be subserved by vacating said portions of street and <br /> alleys and the public will be relieved from the further burden and responsibility of maintaining <br /> the same. <br /> NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF <br /> DECATUR, ILLINOIS: <br /> Section 1. That the above described portions of street and alleys be, and the same are <br /> hereby, vacated as a public street and alleys inasmuch as the same are no longer required for <br /> public use and the public interest will be subserved by such�acation, said portions of street and <br /> alleys being shown on the plat thereof hereto attached and hereby made a part hereof. <br /> Section 2. That there is hereby reserved in, over, along and under the above-described <br /> portion of street and alleys to the City of Decatur, Illinois, and to the public and to those utilities <br /> and companies as the case may be owning public service facilities, mains, sewers, telephone and <br /> electric or other public utilities, such property, rights of way and easements as are or may be <br /> necessary or desirable for continuing public service by means of such facilities and for the <br /> maintenance, renewal and reconstruction thereof with the right of ingress and egress for such <br /> purposes. <br /> Section 3. That the benefits which will be accrued to the owner of abutting property by <br /> reason of the vacation aforesaid is determined to be, in the judgment of the Council, equal to the <br /> sum of Thirteen Thousand Eight Hundred Dollars($13,800.00). <br /> Section 4. That the vacation herein provided for is made upon the express condition that <br /> there shall be paid to the City of Decatur, Illinois, by or on behalf of the owner of the property <br /> abutting upon said portions of street and alleys vacated hereby the sum of $13,800.00 as <br /> compensation for the benefits determined as above set out herein upon the payment whereof such <br /> vacation sha11 become effective. <br /> PRESENTED,P�SSED, APPROVED AND RECORDED ' 6th day of April, 2001.
