ECONOMIC AND URBAN DEVELOPMENT MEMORANDUM
Memo No. O1-36
April 1 l, 2001
TO: ' Honorable Mayor Howley and City Council
FROM: Steve Garm ity Manager
A. J. Krieger, onomic and Urban Development Department
Steven J. Van teenhuyse, Planning Mana e7V
Joselyn Stewart, Transportation Planner
SUBJECT: Request to rezone from R-2, Single Family Residence District to O-1, Office
District - 2455 East Pershing Road
SUMMARY RECOMMENDATION: The owners wish to rezone the subject property from
R-2 to O-1, for the purpose of operating an EEG lab in the existing building. This rezoning is
consistent with earlier approvals on the.same street. The O-1 District provides adequate
screening for the surrounding residential uses. Therefore, staff recommends approval of the
proposal.
BACKGROUND: _The subject property contains a 14,000 square foot lot. The property is
improved with a single-family detached residence structure. The property is bounded by
residential uses on the south, west and east sides. City water and sanitary sewer services are
available to the site. Access is currently available from Pershing Road and also available from
North 25` Street.
The Plan Commission originally considered rezoning of this property from R-2 to B-1 at the
March 1, 2001 meeting. It was suggested by the Commission that the petitioners consider O-1
instead of the more intense B-2 zoning. The petitioners ageed to amend their petition to O-1.
The Plan Commission considered the amended petition on April 5, 2001.
If said property were to be rezoned to O-1 the following ordinance requirements would have to
be met:
1. A site break fence would need to be constructed along the south and west property lines,
where it abuts residential zoning, not less than four(4) feet nor more than six (6) feet.
(The petitioner stipulated that the fence would be six feet high).
2. Parking would not be allowed in the front yard along either street. Zoning regulations
require that two 25 foot side yard setbacks be provided on the north and east sides of the
property, therefore placing any and all parking in the back of the property.
3. There would have to be a minimum of 4 parking stalls, including one handicapped space.
4. The access drive to the parking shall be 24 feet in width, or two 12 feet directional drives.
