` y w
COUNCIL COMMUNICATION FORM
Engineering & Infrastructure Memorandum
NO. 2001-14
March 14, 2001
TO: Honorable Mayor Howley and City Council
FROM: Steve Garman, City Manager / '
Stephen P. Swanson, P.E.,Director of Engineering & InfrastructureC

SUBJECT: Hickorywood Storm Sewer Outfall Project Land Acquisitions 'I
SUMMARY RECOMMENDATION: Ili
It is recommended by City staff that the City Council approve the attached resolution authorizing II
the use of the City's right of Eminent Domain for the acquisition of temporary and permanent
easements from the property located at 250 Hickorywood Drive for the purpose of storm
drainage improvements.
BACKGROUND:
Residents in the neighborhood lying generally north of Hickorywood Drive and east of Martin
Luther King, Jr., Drive (MLK) (refer to attached locale map) have complained in the past about
flooding problems from the overtopping of MLK from heavy storm runoff. This flooding has
been the result of blockages to the intake structure on the east side of MLK from cornstalks or
other field crop residue. The problem is compounded because the twin 48-inch diameter storm
sewer pipes beginning at MLK and ending at Crescent Drive empty into a single 48-inch
diameter sewer pipe.
At the time that MLK was improved, the extension of the 48-inch pipes beyond Crescent Drive
was not completed because of design and easement description issues which could not be
resolved in a timely manner. The project was recently resurrected by staff and the design for the
extension of the 48-inch pipes completed. The construction of the new pipes required temporary
and permanent easements to be obtained from adjoining property owners. The easements are
needed for the City's contractor to access the work area, install the pipe and backfill and grade
the area after the pipe is installed.
