. � , <br /> i <br /> � <br /> Page 2 <br /> The services of Mr. Norm Lienemann, Real Estate Services, was obtained by City staff to <br /> acquire the needed easements from the various property owners subject to City staff input. Mr. <br /> Lienemann was successful in obtaining easements from all but one property owner. This <br /> property is located at 250 Hickorywood Drive. Mr. Lienemann made a number of contacts with <br /> the property owner, Mr. Dan Luka, in an effort to arrive at a reasonable compensation for the <br /> temporary and permanent easements needed from his property (refer to attached drawing). In <br /> addition, Stephen Swanson, Director of Engineering & Infrastructure, and Mr. Lienemann met <br /> with Mr. Luka one evening and had reached a tentative agreement for the easement. Mr. Luka <br /> subsequently changed his mind and further efforts were unsuccessful. <br /> The City's Legal Department was then asked to contact Mr. Luka prior to the City pursuing <br /> condemnation for the easements. The Legal Department was not successful and for this reason <br /> City staff is asking authorization to proceed with condemnation for the easements. <br /> POTENTIAL OBJECTION: <br /> Mr. Dan Luka, the property owner, may speak to object about the potential taking of his property <br /> for the proposed improvements and of other direct or indirect issues associated with the City. <br /> INPUT FROM OTHER SOURCES: <br /> Mr. Norm Lienemann, Real Estate Services, acting on behalf of the City for the property rights <br /> acquisitions, provided background information regarding the unsuccessful negotiations with the <br /> property owner. <br /> STAFF REFERENCE: Stephen Swanson, Director of Eng. &Infrastructure at 424-2747. <br />' BUDGET/TIME IMPLICATIONS: <br /> The cost of the temporary and permanent easements is subject to final settlement. The project <br /> will not be advertised for bids until all easements have been obtained.
