Brag Planner� <br /> SUBJECT: Rezoning 20 8 East Damon Avenue from R-2 to M-1 <br /> SUMMARY RECOMMENDATION: Staff recommends denial of the petition as proposed. <br /> The proposed use is not a desirable land use adjacent to residential property and is inconsistent <br /> with the intent of the land use plan. Staff believes that the proposed rezoning,while increasing <br /> the value of the subject property, would have a deleterious effect on property values and <br /> marketability in a distressed residential neighborhood. <br /> Notwithstanding the petitioner's intended use and because zoning runs with the land and not the <br /> property owner, rezoning must be judged based on the merits of permitted uses. Staff does not <br /> encourage the use of property for storage yards, light manufacturing, truck terminals or car <br /> dealerships when located immediately adjacent to residential property on three sides. Staff <br /> believes that the proposed rezoning would not create a desirable land use adjacent to the existing <br /> residential properties and would not represent a sound land use policy to protect neighborhoods. <br /> BACKGROUND: The petitioner proposes to rezone the 1.93 acre tract from R-2, Single Family <br /> Residence,to M-1, Light Industrial District to operate a filter media service from the site. The <br /> petitioner proposes to construct a 1,600 square foot office building and a 3,200 square foot , <br /> warehouse. City water and sanitary sewer services are available to the site. Property to the north <br /> is zoned M-2, Heavy Industrial,properties to the west, east and south are zoned R-2, Single <br /> Family. This parcel is depicted as low-density residential on the Decatur Urban Area Land Use ' <br /> Plan. There is no apparent shortage of property zoned for industrial use within the northeast ', <br /> sector of the City. ' <br /> POTENTIAL OBJECTION: There are no known objectors to this petition. <br /> INPUT FROM OTHER SOURCES: The City Plan Commission voted 7-1 to recommend <br /> approval of this petition at the March 1, 2001 hearing. Minutes of the meeting are attached. <br /> STAFF REFERENCE: Any additional questions may be forwarded to Dane Bragg at <br /> 424-278 l. <br /> BUDGET/TIME IMPLICATIONS: None <br />
