Excerpts from Plan Commission Minutes of March 1, 2001
Cal. No. O1-OS Petition of BRIAN K. and BECKY J. BURCHAM, 2008 EAST
DAMON AVENUE, to rezone the premises from R-2 Single
Family Residence District to M-1 Light Industrial District.
Mr. Bragg presented the recommendation of staff: II
The petitioner is requesting the rezoning of a 1.93 acre tract from R-2, Single Family, to M-1, I
Light Industrial. The site contains a 2,000 square foot residential building and a 600 square foot
accessory structure. City water and sanitary sewer are available to the site. Properties to the 'i
north are zoned M-2, Heavy Industrial and properties to the west, east and south are zoned R-2, 'i
Single Family Residence District. This area is depicted as low-density residential on the Decatur ',
Urban Area Land Use Plan. I,
The petitioner is requesting the rezoning to operate a filter media service from the site. The
petitioner proposes to construct a new 1,600 square foot office building and a new 3,200 square
foot warehouse associated with the business.
Staff is cautious of evaluating rezonings of this type in established residential neighborhoods.
Traffic entering and exiting the site would be required to use a residential street. And, while the
petitioner's proposed use does not present a high tra.ffic-generating or highly intensive land use, I
the potential for intense uses by another property owner is great. M-1 zoning would allow many ,
intense uses such as a car dealership, truck terminal, storage yard or one-site manufacturing. Staff '
is of the opinion that the proposed rezoning is not consistent with the intent of the land use plan 'I
and is not a desirable land use adjacent to residential property on three sides. I
Mr. Smith asked if there is a trucking company at the end of Pythian. Mr. Bragg answered yes, '
there is and that company does use Pythian as access. That property is zoned M-2 with Firestone
to the east and adjacent R-2 zoning.
Mr. Shampine questioned the uses allowed in M-l. Mr. Bragg stated that light industrial is
allowed as well as commercial and office uses. It is the second least restrictive zoning
classification.
Mr. Ed Flynn, Attorney, was present and spoke for the petition representing the Burcham's. Mr.
Flynn distributed documents to the Commission. He stated that employees gather at the subject
location for assignments. One hundred percent of the work is done off site to rehabilitate filtering
systems in water treatment plants and occasional work on sanitary sewer systems. The pickup
trucks are put in the shed at the end of the week. Mr. Flynn stated that the Burcham's would be
investing $150,000 to enhance this property and their business. Immediately behind the property
are the railroad tracks. The Burcham's will continue to live in this area as well as their sons. The
three property owners nearby provided letters of support for the petition.
