. .
LEGAL DEPARTMENT MEMORANDUM
NO. 2000-19
DATE: October 11, 2000
TO: Honorable Mayor and City Council Members
FROM: Steve Garman, City Manager
John W. Couter, Corporation Counsel
Steven G. Jones, Assistant Corporation Counsel
RE: Overweight Truck Ordinance
Staff has recommended a new city ordinance making it unlawful for overweight trucks to
be on city streets. The ordinance would also allow the inspection of trucks for safety violations.
Currently, overweight and unsafe trucks found on city streets are prosecuted under the state
statute. The suggested ordinance regarding overweight trucks would mirror that of the state
statute. The only change between the suggested ordinance and the state statute would be that the
City Legal Department would be responsible for the prosecution of said offenses and the City of
Decatur, as opposed to the State of Illinois, would receive the fines from said conviction. .
SGJ:sas
