Excerpts from Plan Commission Minutes of September 7, 2000 Cal. No. 00-60 Petition of TIMOTHY STONE, 2300 North Edwaxd Street, to vacate the alley WEST of CH[TRCH STREET, BETWEEN PYTHIAN AVENUE AND MCKINLEY AVENUE. Mr. Phillip Cochran, Consulting Engineer, was present and spoke for the petition representing Mr. Stone and Decatur Memorial Hospital. Mr. Cochran stated that two years ago a petition was approved to vacate a portion of Union Street right of way. That was done so that the property on the east side of Union Street could be coordinated with the YMCA project on the west. To the east is a parking lot with appro�mately 120 stalls. Petitioner wishes to e�rtend the parking lot to the north for visitors and staff which the vacation of the alley would help to facilitate. Mr. Cochran stated that an appraisal had been made of the a11ey and Decatur Memorial Hospital is in agreement with the appraisal. Mr. Shampine asked if there were houses on the lots. Mr. Cochran stated that the properties had all been purchased within the last two years and the houses were demolished. Mr. Setina asked who owns the property between the alley and Church Street. Mr. Cochran , stated that is owned by the hospital. , There were no objectors present. i, Ms. Miller presented the recommendation of staff: I'I A valid petition has been received from Tim Stone to vacate that portion of the 20 feet wide alley right-of-way extending immediately south of the McKinley Avenue right-of-way line and north of � the Pythian Avenue right-of-way line between the vacated Union Street and North Church Street. The petitioner owns all the property adjoining the alley requested for vacation; this public way does not appear necessary to serve the general public, and staff is of the opinion that the best interests of the City of Decatur would be served by approving the vacation request. A perpetual easement will be retained for operation and maintenance of e�sting utility lines. Further, in accordance with applicable City of Decatur policy, an appraisal was obtained to establish fair market value and compensation to the city for the land in question. The appraisal resulted in a value of$1,872. Staff recommends approval of the proposed alley vacation as submitted. It was moved and seconded (Smallwood/Setina) to forward Cal. No. 00-60 to City Council with recommendation for approval. Motion carried unanimously.
