Mille ,AICP,Planner L�-� <br /> �' '�' <br /> SUBJECT: Vacation of Alley right-of-way north of McKinley Ave. and south of Pythian Ave. <br /> A valid petition has been received from Tim Stone (DMH) to vacate that portion of the 20 feet <br /> wide alley right-of-way extending immediately north of the McKinley Avenue right-of-way line <br /> and south of the Pythian Street right-of-way line between the vacated Union Street and North <br /> Church Street. The petitioner owns all the property adjoining the alley requested for vacation; <br /> this public way does not appear necessary to serve the general public, and staff is of the opinion <br /> that the best interests of the City of Decatur would be served by approving the vacation request. <br /> A perpetual easement will be retained for operation and maintenance of existing utility lines. <br /> Further, in accordance with applicable City of Decatur policy, an appraisal was obtained to estab- <br /> lish fair market value and compensation to the city for the land in question. The appraisal <br /> resulted in a value of$1,872. <br /> The Plan Commission recommended approval of the vacation request the at the September 7 <br /> meeting; minutes are attached. <br /> Staff recommends approval of the proposed alley vacation as submitted. <br />
