Mr. Bragg presented the recommendation of staff: <br /> The petitioner is requesting the rezoning of a 4.44 acre tract located at the southwest corner of <br /> Martin Luther King Jr. Drive and Ash Avenue from R-1 Single Family Residence District, to B-2 <br /> Commercial District and the subsequent approval of a Planned Unit Development on the site. <br /> Property to the north and west is zoned B-2 and B-3, while properties to the south and east are <br /> zoned R-1 Single-Family. All commercially-zoned properties to the north and west are planned <br /> developments. The subject property is designated as"Planned Development, Commercial" on the <br /> Decatur Urban Area Land Use Plan. The property is located within the Wal-Mart TIF District. <br /> City water and sanitary sewer services are available to the site. <br /> The petitioner proposes to construct a 20,,330 squaxe foot, two-story building to house a financial <br /> institution on the site with a 63 stall parking lot, while leaving the south end of the site for <br /> potential future commercial development. Ingress/egress will be accomplished via two curb cuts, <br /> one at Ash Avenue and one at MLK. There will be no access to Maryland Heights Road. <br /> Stormwater detention will be provided in the northeast corner of the site. The petitioner has <br /> proposed the provision of a landscape buffer of 25 feet in width in the southwest corner of the <br /> site. Facade design will be as shown in the attached elevation drawings. <br /> Staff has worked with the petitioner to address the following concerns: � <br /> 1. the relocation of the on-site fire hydrant to appro�mately 150 feet east of the <br /> location shown on the site plan, <br /> 2. the provision of an 8" water main to the relocated fire hydrant, <br /> 3. that the petitioner will provide a detailed landscaping plan to be approved by the <br /> Economic and Urban Development Department, <br /> 4. that access rights will be purchased from the City of Decatur by the petitioner for a <br /> curb cut along NIL,K, <br /> 5. that a 36 foot access be provided along MLK, <br /> 6. that�ighting be so arranged as to prevent intrusion into the residential <br /> neighborhood to the south, <br /> 7. that final signage plans be approved by the Economic and Urban Development <br /> Department, and <br /> 8. that final site plans be submitted for review and approval by the Departments of <br /> Economic and Urban Development and Engineering and Infrastructure. <br /> Staff is of the opinion that commercial development on this site is a logical e�rtension of e�sting <br /> commercial development in the area and supports the petitioner's intention to protect the <br /> residential neighborhood to the south from intrusion. Staff finds the petitioner's proposal to be <br /> acceptable and recommends approval of the proposed rezoning and the planned unit development <br /> as submitted. <br /> Access to Martin Luther King Jr. Drive was discussed. Mr. Bragg stated that the city would <br /> review requests for curb cuts on a case by case basis. In this instance, the Traffic Engineer was <br /> supportive of the request for one curb cut of adequate width for potentially two users. <br />
