Krieger, sist City Manage <br /> Dane Bragg, anner <br /> SUBJECT: Special Use Permit at North Church and West Green Streets <br /> The petitioner is requesting a special use permit under Section XXI of the Zoning Ordinance to <br /> permit the establishment of a privately-owned community center on a 36,500 square foot tract <br /> generally located on the northwest corner of Green and Church Streets. The proposed <br /> development is located in the Old King's Orchard neighborhood and the subject property is <br /> zoned R-6, Multiple Residence District. Properties to the north and west are zoned R-6, property <br /> to the east is zoned O-1 and property to the south is zoned M-1. Land use in the area is generally <br /> single and multi-family residential with limited commercial development to the south of Green <br /> Street. City water and sanitary sewer service is available to the site. <br /> The petitianer proposes to construct a 10,962 square foot facility and a 15 stall parking lot on the <br /> site, with a 25 stall parking lot located across North Church Street. Overflow parking on North <br /> Church would be located in an O-1 district. Handicapped parking will be provided on-site. <br /> Circulation would be accomplished via two access drives located on Church Street. <br /> The petitioner is requesting the following variations from the Zoning Ordinance: <br /> 1) to reduce the required rear yard setback along the north side of the property from <br /> 12' to 10', and <br /> 2) to allow a 10 foot encroachment into the required front yard setback along Green <br /> Street for parking. <br /> Staff has met with the petitioner regarding these requests and finds the 10' setback along the rear <br /> property line and the parking area encroachment to be acceptable provided that a landscaping <br /> plan be prepared to screen parking, etc. from street view. The petitioner has agreed to maintain <br /> the required setback along the Church Street"overflow"parking area. <br /> Staff is of the opinion that this proposal will be generally consistent with neighboring land use <br /> and will provide a low-intensity, non-intrusive development for the area. Staff finds the <br /> petitioner's proposal to be acceptable and recommends approval of the petition as proposed. <br /> Final site plans and building drawings shall be submitted to the Departments of Economic and <br /> Urban Development and Engineering and Infrastructure for final approval. <br />
