The subject property is a 1.29 acre parcel on the south side of McKinley Avenue.
Mr. Cochran stated that in 1998, 2.2 acres were rezoned from R-1 to R-6 for an assisted living
facility which did not fit on the parcel. The rezoning requested today would allow for the facility
to be constructed. Mr. Cochran stated that property to the east is zoned R-6 and there are
adequate utilities.
Mr. Shampine questioned if there were anticipated problems with drainage. Mr. Cochran stated
that there has been no construction on the property since 1998 and upon construction there
would be adherence to the City's policies for water detention/retention. Retention will be
provided on the property.
Mr. Shampine questioned if Country Club Trails is a Planned Unit Development. Mr. Cochran
stated that it is not. Twin Oaks is an R-5 Planned Unit Development.
There were no objectors present.
Mr. Forgey presented the recommendation of staff:
The petitioner proposes to rezone a 2.04-acre parcel on the south side of McKinley Avenue
between Oakland Avenue and Monroe Street from R-1, Single Family Residential, to R-6,
Multi-family Residential. The property is illustrated on the Future Land Use Map, a component
of the Decatur comprehensive plan, as High Density Residential. There is multiple family
development to the east and across the street to the north. There is R-1 zoning to the south and
west. This is a relatively large tract of land; the proposed use is generally consistent with land
uses in the neighborhood.
Staff recommends approval of this petition as proposed.
It was moved and seconded(Schiller/Jacobs) to forward Cal.No. 00-39 to City Council with
recommendation for approval. Motion carried unanimously.
Commissioner Jacobs left the meeting.
Cal. No. 00-40 Public Hearing for the designation of a Conservation Area(Chapter 49.1)
in the Near North Redevelopment Area by the City of Decatur, Illinois.
Mr. Krieger stated that this is one of two required Public Hearings for the Conservation Area
which includes the Near North Redevelopment Area and, generally, businesses to the west.
