Excerpts from April 6, 2000 City Plan Commission Minutes !,

Cal. No. 00-27 Petition of McDONALD S CORPORATION to vacate a portion of the
alley located west of 19th Street between East Eldorado Street and East
North Street.
Mr. Richard Heavner, Attorney, was present and spoke for the petition stating that the request
goes hand in hand with the rezoning petition. The vacation is necessary for rebuilding of the
restaurant. An agreement has been reached with all of the utility companies.
There were no objectors present.
Mr. Forgey stated that staff recommends approval of the request.
Mr. John asked if staff feels the turn around is important to approval of the request. Mr. Forgey
answered yes. Mr. John asked if it was considered to locate the turn around on dedicated City
property versus private property. Mr. Heavner stated that petitioner would be happy to grant an
easement.
Mr. Sharp stated that McDonald's Corporation is the land owner and might be concerned if the
land was not theirs.
Mr. Heavner stated that an easement could be given as long as the rest of the alleyway was not
vacated. The easement could then be terminated if the rest of the alley was vacated.
It was moved and seconded Schiller/Peck to forward Cal. No. 00-27 to Cit Council with
 ) Y
recommendation for approval. Motion carried with Commissioner Smith abstaining from the
vote.
