' ler, AICP, Planner�l, <br /> SUBJECT: Vacation of a portion of the Alley in the Block between East North Street <br /> and East Eldorado Street west of North 19th Street <br /> A valid petition has been received from McDonald's Corporation to vacate that portion of the <br /> alley extending immediately west of East North Street for a distance of 160 feet(16' X 160; total <br /> of 2,560 square feet). The petitioner owns all the property adjoining the portion of the alley <br /> requested for vacation. Other property owners adjoin the unvacated portion of the alley; a <br /> turnaround will be provided by McDonald's Corporation. The petitioner notified all adjacent <br /> property owners of the pending vacation. The e�sting utilities in the alley will be relocated in <br /> order to construct a building over this portion of the alley. This public way does not appear <br /> necessary to serve the general public; staff is of the opinion that the best interests of the City of <br /> Decatur would be served by approving the alley vacation request. The Plan Commission <br /> recommended approval at the Apri16, 2000, meeting with a vote of 8 to 0 and 1 abstention; <br /> minutes are attached. <br /> No easement will be retained for this vacation. Further, in accordance with applicable City of <br /> Decatur policy, two appraisals were obtained to establish fair market value and compensation to <br /> the city for the land in question. The petitioner submitted an appraisal for $3,200 or $1.25 a <br /> square foot. Based on the petitioner's comparable sales, reported sales ranged from $1.25 to <br /> $6.30 a square foot. The second appraisal placed value at $3,800 or $1.48 a square foot. The <br /> comparable sales of the second appraisal ranged from $2.00 to $4.11 a square foot. Based on the <br /> direction from City Council on August 2, 1999, the petitioner will pay the city $3,800 for the <br /> vacated property. <br /> Staff recommends approval of the proposed alley vacation as submitted. <br />
