Mil er, AICP, Planner �.�1�1�� <br /> SUBJECT: Vacation of a portion of the Alley in the Block between North Church Street <br /> and North Main Street from West William Street to West North Street <br /> A valid petition has been received from Huston Patterson Printers to vacate that portion of the � <br /> . alley e}rtending immediately south of West North Street for a distance of 240 feet (16' X 240; <br /> total of 3,840 square feet). The petitioner owns all the property adjoining the portion of the alley <br /> requested for vacation. One other property owner adjoins the alley; a turnaround is provided by i <br /> the adjacent parking lot. The petitioner notified all adjacent property owners of the pending <br /> vacation. This public way does not appear necessary to serve the general public; staff is of the <br /> opinion that the best interests of the City of Decatur would be served by approving the alley <br /> vacation request. The Plan Commission recommended approval at the Apri16, 2000, meeting <br /> with a vote 9 to 0; minutes are attached. <br /> A perpetual easement will be retained far operation and maintenance of existing utility lines. <br /> Further, in accordance with applicable City of Decatur policy, two appraisals were obtained to <br /> establish fair market value and compensation to the city for the land in question. The petitioner <br /> submitted an appraisal for $5,760 or $1.50 a square foot. Based on the petitioner's comparable <br /> sales, reported sales ranged from $1.25 to $6.30 a square foot. The second appraisal placed <br /> value at $3,000 or $0.78 a square foot. The comparable sales of the second appraisal ranged from <br /> $1.25 to $4.80 a square foot. Based on the direction from City Council on August 2, 1999, the <br /> petitioner will pay the city $5760 for the vacated property. <br /> Staff recommends approval of the proposed alley v�cation as submitted. <br />��_ <br />
