Prior to the City having the <br /> obligation to pay the severance amounts, i.e., the six (6) months <br /> salary at the then current rate,described herein,the City may require <br /> Employee to execute a binding and effective release of any and all <br /> claims that Employee might otherwise possess against the City, <br /> except that the City. <br /> The parties hereto wish to supplement said provision to provide for further benefits paid to <br /> Employee if the Agreement is terminated by the City,without cause, as defined within§ 4(a)of the <br /> Agreement, which further benefits include certain health, dental and life insurance benefits as <br /> included within this amendment. Section 4(c) of the Agreement now provides, in its entirety, as <br /> follows: <br /> If this Agreement is terminated by the City,without cause as defined <br /> within § 4(a) hereof, at any time within the applicable term hereof, <br /> the City shall pay, as severance pay,to Employee a sum equal to six <br /> (6) months salary at Employee's then current rate of salary. i, <br /> Employee shall also be paid for all earned and unused(in accordance '� <br /> with the terms hereo fl sick leave, vacation, holidays and other 'i <br /> accrued benefits to the date thereof. Moreover, the City shall provide to Employee, <br /> without cost to Employee, all health and dental benefits described <br /> herein for a period of twelve(12)months following said termination, <br /> and the life insurance policy described in § E of this Amendment to <br /> Employment Agreement shall continue for said twelve (12) month <br /> period at the expense of the City, so long as Employee remains <br /> insurable. <br /> D. Section 6 of the Agreement provided formerly as follows: <br /> Employee's Salary and Retirement. Employee shall receive <br /> a salary at an annual rate of One Hundred Ten Thousand Dollars <br /> ($110,000.00) from the period commencing as of the effective date <br /> hereof,and such salary shall be payable in bi-monthly installments as <br /> -3- <br />
