� Employee a suxn equal to six (6) months salary at Employee's then current rate of salary. <br /> Employee shall also be paid for all earned and unused (in accordance with the terms hereo fl sick <br /> leave, vacation, holidays and other accrued benefits to the date thereof. Prior to the City having <br /> the obligation to pay the severance amounts, i.e., the six (6) months salary at the then current <br /> rate, described herein, the City may require Employee to execute a binding and effective release <br /> of any and all claims that Employee might otherwise possess against the City, except that the <br /> City must pay to Employee all earned and accrued vacation, sick days and wages in accordance <br /> with law. <br /> 5. Disability. If Employee is permanently disabled due to sickness, accident, <br /> injury, mental incapacity or ill health for a period of four (4) successive weeks beyond any <br /> accrued sick leave, the City shall have the option to terminate this Agreement, subject to the <br /> severance pay requirements of§ 4(c)hereof. <br /> 6. Employee's Salary and Retirement. Employee shall receive a salary at an <br /> annual rate of One Hundred Ten Thousand Dollars ($110,000.00) from the period commencing <br /> as of the effective date hereof, and such salary shall be payable in bi-monthly installments as <br /> equalized as reasonably possible in accordance with the pay plan generally applicable to all <br /> employees of the City. Employee agrees that his salary shall be subject to normal and customary <br /> withholdings which Employee hereby irrevocably appoints the City as his agent to report such <br /> compensation to federal and state taxing authorities as may be required by law. The City also <br /> agrees to review periodically said salary, and the City may increase said salary if deemed <br /> desirable to the City. <br /> 4 <br />
