Excerpts from Plan Commission Minutes of July 1, 1999 <br />, Cal. No. 99-52 Petition of ARCHER DANIELS MIDLAND to vacate Division Street <br /> between Railroad Avenue and Clinton Street. <br /> Mr. Terry Mason was present and spoke for the petition representing Archer Daniels Midland. <br /> Mr. Mason stated that the company wants to close Division Street running east and west which <br /> used to be access to ADM Mason. That facility is in the process of being closed. There is a chain <br /> link fence around the property and there would be a fence with a gate on Division and Clinton <br /> Streets on the west and a fence with a gate on Division Street and Railroad Avenue on the east. <br /> The intent is to close offthe street and lock the gates. <br /> There were no objectors present. <br /> Ms. Miller questioned the names of the contacts at the railroad. Mr. Mason stated that he had <br /> spoken with Ron Lord in Decatur and Randy Numeyer had spoken with Ed Harris in Chicago. <br /> Ms. Miller presented the recommendation of staff: <br /> A valid petition has been received from Archer Daniels Midland to vacate that portion of Division <br /> Street extending immediately east of Clinton Street to the west right of way line of Railroad <br /> Avenue. The petitioner owns all the property adjoining the street requested for vacation; this <br /> public way does not appear necessary to serve the general public, and staff is of the opinion that <br /> the best interests of the City of Decatur would be served by approving the vacation request. <br /> A perpetual easement will be retained for operation and maintenance of existing utility lines. <br /> Further, in accordance with applicable City of Decatur policy, two appraisal were obtained to <br /> establish fair market value and compensation to the city for the land in question($4,250 by the <br /> petitioner and the second appraisal at $2,816). The average ofthese appraisals resulted in a value 'i <br /> of$3,533. , <br /> Sta.ff recommends approval of the proposed street vacation as submitted. i <br /> � <br /> It was moved and seconded (Schiller/Gentry)to forward Cal. No. 99-52 to City Council with '' <br />' recommendation for approval as presented. Motion carried unanimously. I <br />
