Miller, AICP, Planner���'y'� <br /> SUBJECT: Vacation of East Division Street between Clinton Street and Railroad Avenue <br /> A valid petition has been received from Archer Daniels Midland to vacate that portion of Division <br /> Street e}rtending immediately east of Clinton Street to the west right of way line of Railroad <br /> Avenue. The petitioner owns all the property adjoining the street requested for vacation(ADM <br /> owns all but three properties north to Olive Street and approximately 200 feet to the south of the <br /> tracks); this public way does not appear necessary to serve the general public, and staff is of the <br /> opinion that the best interests of the City of Decatur would be served by approving the vacation <br /> request. The Plan Commission recommended approval at the July 1 meeting; minutes are <br /> attached. <br /> A perpetual easement will be retained for operation and maintenance of existing utility lines. <br /> Further, in accordance with applicable City of Decatur policy, two appraisals were obtained to <br /> establish fair market value and compensation to the city for the land in question($4,250 by the <br /> petitioner and the second appraisal at $2,816). The average of these appraisals resulted in a value <br /> of$3,533. <br /> Staff recommends approval of the proposed street vacation as submitted. <br />
