Cal. No. 99-06 Petition of D. C. 1NVESTMENT GROUP, L.L.C., to rezone a tract of <br /> land located near the intersection of North Brush College Road and East <br /> Boyd Road from R-1 Single Family Residential District to M-1 Light <br /> Industrial District. <br /> Cal. No. 99-07 Petition of BOB BRADY to rezone property commonly known as 3855, <br /> 3955 and 4025 East Boyd Road from R-1 Single Family Residential <br />' District to M-1 Light Industrial District. <br /> Mr. Phillip Cochran, Consulting Engineer, was present and spoke for the petition representing D. <br /> C. Investment Group and Bob Brady. NIr. Cochran noted that his presentation would cover both <br /> Cal. No. 99-06 and Ca1. No. 99-07 etition of Bob Brad . The sub�ect ro ert contains 32 <br /> P Y J P P Y <br /> acres. Mr. Brady owns Lot 1 and D. C. Investment Group owns Lots 2, 3, 4, and 5. The <br /> property was annexed to the City of Decatur and automatically zoned R-1. At that time the <br /> request was not made to rezone the property to M-1. Prior to annexation the property was zoned <br /> M-1 under County regulations. Mr. Cochran stated that this would be a major development for <br /> the City of Decatur and requires an M-1 zoning. The project will commence when weather <br /> allows. Site plans have been submitted for review. <br /> There were no objectors present. <br /> Ms. Miller presented the recommendation of staff: <br /> The sub�ect etition Cal. No. 99-06 re uests that a 16 acre tract of land located east of Brush <br /> J P � ) q <br /> College Road and South of Boyd Road be rezoned from R-1 Single Family Residence District to <br /> M-1 Light Industrial District. The area in question was recently annexed into the Decatur city <br /> limits. <br /> Upon review of land use and zoning patterns for the general area, staff notes that prior to <br /> annexation to the city, the area from Richland Community College to Boyd Road for 1/2 mile east <br /> of Brush College Road was zoned M-1 Light Industrial by the county and used mostly as farm <br /> land. Most of the area west of Brush College is zoned M-1 or M-2, with the exception of 500 <br /> feet from Larkdale which is zoned R-1. Areas to the south of the tract and west of Brush College <br /> Road that are within the city limits are zoned both M-1 Light Industrial and M-2 Heavy Industrial <br /> and developed as such. <br /> Upon review of the Comprehensive Land Use Plan of 1990, sta.ff notes that the subject premises <br /> are earmarked for Light industrial and commercial development. Consequently, 'the proposed <br /> zone would be in keeping with the intent of the land use plan as noted. <br /> City of Decatur water and sanitary sewer utilities will be extended to the property. Access to the <br /> site will be from Boyd Road. Internal design and review of the infrastructure serving this tract will <br /> occur prior to issuance of required building permits. Further, proposals for development will be <br /> subject to applicable provisions of the subdivision ordinance and zoning ordinances. <br />
