Mr. Shampine questioned if Route 51 would be affected. Mr. Livergood stated that turning the
building solved that problem. Access to Fisherman's Wharf will be owned by the Pazk District.
Mr. Schiller noted that the building will be located right up to the IDOT controlled property with
no landscaping on the highway side. Mr. Livergood stated that a variance for a zero foot setback
was granted by the Zoning Board of Appeals at their meeting two months ago. He stated that the
bulk of the building would be away from the property line and it is the intent of the petitioner to
landscape wherever possible.
Mr. Shampine questioned if traffic would be making a blind turn at this intersection. Mr.
Livergood stated that there would be no blind turns and that people are aware of the intersection.
There were objectors present:
Mr. Doug Imboden, #3 Sixth Drive, was present and spoke against the petition representing the
South Shores Neighborhood Organization. He stated that the traffic study was not included in the
information he had received from the City of Decatur when he filed a Freedom of Information
request. Mr. Imboden stated that information had not been shared as to the expected increase in
; traffic due to this development. He questioned the type of traffic to service the business such as
semi trucks.
NIr. George Finch, 36 lst South Shores Avenue, was present and spoke against the petition
stating that he can hear the tires squealing as trafc attempts to stop at 7:30 A.M. He stated that
it is difficult to get across South Franklin Street Road at 5:00.
Mrs. Townsend presented the recommendation of staff:
The subject petition requests a revision to a B-3 Planned Shopping District . The property is
currently zoned B-3 Planned Shopping Center District and has been zoned as such since the
1960's. This property was originally zoned as part of the larger B-3 South Shores Development ,
Tract that has previously been developed and divided by the construction of the highway system. ,
The proposed development consists of a medical and banking facility.
A variance has been granted by the Zoning Board of Appeals allowing a reduction of the 30 foot
front setback to 0 feet.
After extensive staff review, the petitioner has met all the requirements as defined in the revision
of a Planned Unit Development including site plan review and traffic survey report. Staff
recommends approval of the petition with the following stipulations:
1. The resolution of land agreements between the County, City and Park District.
2. The receipt of Illinois Department of Transportation permit.
3. Final approval of site plans by the Department of Community Development and
Department of Public Works.
