Ezcerpts from the Minutes of the July 9, 1997 City Plan Commission Meeting <br /> Cal. No. 97-38 Petition of JOHN CARDWELL w rezone a tract of land located at the <br /> southeast corner of West Grove Road and U. S. Route 51 South from <br /> R-1 Single Family Residence District and B-1 Neighborhood Shopping <br /> District to B-2 Commercial Disrrict. <br /> Mr. Phillip Cochran, Consulting Engineer, was present and spoke for the petition representing <br /> Mr. Cardwell. Petitioner requests the rezoning of 45 acres, a portion of which is zoned B-1 and <br /> the remainder R-1. Mr. Cochran stated that thirty of the acres are located outside of the corporate <br /> city limits and an annexation petition has been filed. The rezoning petition requests that a1145 <br /> acres be rezoned to B-2. Land to the north is zoned B-2 and R-6 and land to the south is zoned <br /> B-2 which includes Hyde Park. Mr. Cochran stated that there is adequate water and sewer to <br /> serve the site and a watermain is located in Grove Road. <br /> There were no objectors present. <br /> Mr. McQueen presented the recommendation of staff: <br /> The subject petition requests that a vacant tract of land located at the southeast corner of Route <br /> 51 South and West Grove Road be rezoned from R-1 Single Family Residence District and B-1 <br /> Neighborhood Shopping District to B-2 Commercial District. Property at the immediate <br /> southeast corner of said intersection containing approximately three acres is zoned B-1 while the <br /> balance of the subject tract is or upon annexation to the City of Decatur will be zoned R-1; an <br /> annexation petition has been filed regarding approximately 30 acres of the area in question. The <br /> total land proposed for the B-2 classification consists of approximately 45 acres. <br /> Staff notes that property to the north across Grove Road is presendy zoned B-2, and that property <br /> located 800 feet to the south and east of Route 51 is also zoned B-2. Staff is of the opinion that <br /> the proposed zone is in keeping with existing patterns as noted as well as the Comprehensive <br /> Land Use Plan, which designates commercial development at this corner of the subject <br /> intersection. With regards to utilities, both City water and sanitary sewer are available to serve <br /> the azea in question. <br /> Staff recommends approval of the petition as presented. <br /> It was moved and seconded (Demirjian/Golden) to forward Cal. No. 97-38 to City Council with <br /> recommendation for approval as presented. Motion carried unanimously. <br />
