Section 2. That upon the conditions hereinafter mentioned, a special use permit be, and it <br /> is hereby granted to Steve Horve, Jr. to develop the premises described above under a R-3 <br /> Planned Unit Development in accordance with the plat and plans hereto attached, marked Exhibit <br /> A and hereby made a part hereof. <br /> Section 3. That prior to issuance of any building permits for a specific use, the following <br /> shall be provided: <br /> A. That development be in accordance with plat and plans submitted by <br /> petitioner, and attached hereto and made a part hereof as Exhibit A. <br /> B. That prior to issuance of any building permits, complete construction plans <br /> for, but not limited to, watermains, sanitary sewers, streets and landscaping be submitted to and <br /> approved by the Departments of Community Development and Public Works, and further that <br /> easements be dedicated to the City of Decatur for proposed watermains and sanitary sewer <br /> utilities. <br /> C. That prior to issuance of any building permits, East Fulton Avenue shall be <br /> improved to minimum City of Decatur construction for a residential street from the west line of <br /> the subject tract, easterly to Albany Street, with the costs of said improvement shared equally by <br /> the Developer and the City of Decatur; the Developer may submit the appropriate improvement <br /> bond in lieu of immediate construction. <br /> Section 4. That said special use permit granted hereby be, and it is hereby, made subject <br /> to the applicable provisions and requirements of Ordinance No. 3512, the same being the Zoning <br /> Ordinance of the City of Decatur, Illinois, and that the Zoning Map of said City be amended in <br /> accordance therewith. <br /> PRESENTED, PASSED, APPROVED AND RECORDED this 15th day of September, <br /> 1997. 1 <br /> �! <br /> E M.
