PETITION FOR ZONING ORDINANCE AMENDMENT <br /> November 26, 1996 <br /> TO: Mayor Terry M. Howley <br /> City Council <br /> City Plan Commission <br /> I, George C. Weaver, Director of Community Development, hereby request amendment to <br /> Section II. and Section XXI. A.l. of the Zoning Ordinance (Ord. #3512) by adding the following <br /> language thereto respectively: <br /> Section II. (Definitions� <br /> 93. Neighborhood Preservation Use: A use of land in a Neighborhood Preservation <br /> District as established by specific ordinance by the Decatur City Council that, <br /> with appropriate controls under specific conditions, is consistent with and <br /> preserves the essential character and nature of the surrounding neighborhood, but <br /> which is not listed herein as a permitted use in the particular zoning district <br /> applicable to and underlying such land. <br /> Section XXI. A. 1. (Special Use Regulations� <br /> a.a. Neighborhood Preservation Use: Neighborhood Preservation Use, but only for a <br /> specific use and only if the proposed use and e�erior appearance of the building <br /> as shown by plans and drawings submitted by the petitioner preserves the <br /> residential character of such building and the general neighborhood; such proposal <br /> and plans may be conditioned as felt necessary by the City Council to achieve this <br /> preservation goal. <br /> The purpose of the proposed amendment is to provide utilization and preservation of specific <br /> residential structures located in areas where the underlying zone would otherwise prohibit the <br /> requested use. The proposed amendment would allow further discretion of land use beyond the <br /> underlying zone with the ability to establish specific development controls, thus accommodating <br /> and encouraging new development but remaining compatible with the general neighborhood. <br /> Respectfully submitted, <br /> George C.
