Decatur City Plan Commission <br /> December 5, 1996 � <br /> Page Two <br /> elevation of structures, maintaining a residential appearance, type of signage, etc. Neighborhood <br /> Preservation Use would not be city wide but only in a designated area yet to be determined. <br /> � Mr. Swartz stated for clarification that the designated area would be bound by particular streets <br /> and zoned residential with this specific regulation. Mr. McQueen stated that the boundaries <br /> would be designated such as is done in the Historic Preservation area. Presently, office and retail <br /> uses are not permitted in residential zones and such would necessitate a zoning change. There <br /> are cases where it is not desirable to change the underlying zoning. Each petition for a special <br /> use permit would be reviewed on an individual basis and there will be specific program <br /> guidelines. <br /> Mrs. Washington questioned if there were currently requests for this type of use or if the intent <br /> was to plan for the future. Mr. McQueen stated that there are no specific requests at this time but <br /> ongoing inquiries are received. Existing regulations do not accommodate this type of operation <br /> under the home occupation clause. <br /> Mr. Shampine questioned if the City will establish the boundary before the requests are allowed. <br /> Mr. McQueen stated that it is anticipated that a given area will be designated as was done for the <br /> historic areas. There may be other areas in the future if warranted. The City Council will <br /> designate the areas. Approval of the requests are not automatic and will be subject to a review <br /> process. <br /> Mr. Shampine questioned if the program guidelines are written. Mr. McQueen answered no and <br /> stated that a site plan would have to be submitted for each proposal and then the provisions of the <br /> Zoning Ordinance would regulate the requests. Should a specific request not seem appropriate <br /> then the determination is at the discretion of the Plan Commission and City Council. <br /> Mr. Swartz stated that he is in support of development possibilities yet concerned with rezoning <br /> a block from R-3 to O-1 as it is, in fact, a change in zoning. Mr. McQueen stated that the <br /> underlying zone does not change. The use would be permitted by means of a special use permit. <br /> It was moved and seconded (Shampine/Demirjian) to forward Cal. No. 96-93 to City Council <br /> with recommendation for approval as presented. Motion carried unanimously. <br /> Cal. No. 96-94 Petition of DEBBIE LEWIS and others to rezone the premises commonly <br /> known as 2621-2685 North Main Street from R-3 Single Family <br /> Residence District to B-1 Neighborhood Shopping District. <br />
