as the City hires a City Manager to replace the prior City '_�Ianager, and said individual is lawfully <br /> qualified to act as City'_vlanager pursuant to the terms of§ 5-3-7 of the IllinoisMunicipal Code (65 <br /> ILCS 5/5-3-7 (1994)), as such provision e�sts currently, or may be amended hereafter, subject to <br /> the rights of the parties to terminate this Agreement as is more particularly provided in § 15 of this <br /> Agreement. I�'othing contained herein shall provide to Employee any greater right to seek the <br /> position of City �Ianager, nor shall anything contained herein diminish the opportunities of the <br /> Employee to seek the position of City'_�Ianager on a full-time indefinite basis. <br /> 2. EyfPLOYEE'S DUTIES. During the period of employment described herein, <br /> Employee shall perform the duties and possess the responsibilities of City Manager as set forth <br /> within the applicable statutes of the State of Illinois, and more specifically § 5-3-7 of the Illinois <br /> Municipal Code (65 II.CS 5/5-3-7 (1994)), as said provision now exists, or may be amended <br /> hereafter, and all ordinances lawfully enacted pursuant thereto, and such duties and responsibilities <br /> as the City Council of the City may lawfully assign to Employee. <br /> 3. OTHER EMPLOYMENT. Employee shall devote all of his time, attention, <br /> knowledge, and skills solely to the interest of the City, and the City shall be entitled to all of the <br /> benefits arising from or incident to all work, services, and advice of Employee. <br /> 4. OATH A_ND BOND. Employee agrees to provide an oath and provide a bond, with <br /> surety, as required by § 5-3-9 of the IllinoisMu�iicipal Code (65 ILCS 5/5-3-9 (1994)). <br /> 5. HOURS OF WORK. The parties realize that the duties and responsibilities of the <br /> acting City Mana�er require the person holdin�such position to work weekends, evenings, and other <br /> irregular hours at locations including the administrative offices of the City, as well as elsewhere, <br /> -2- <br />
