That upon the conditions hereinafter mentioned, authority be, and is hereby <br /> granted to Central States Tower III,LLC located at 323 South Hale Street, Suite 100,Wheaton, <br /> Illinois, and only to Central States Tower III, LLC to construct, operate and maintain a <br /> freestanding 120 foot high monopole type cellular communications tower and equipment <br /> buildings upon the premises aforesaid and in accordance with the site plan thereof hereto <br /> attached marked Exhibit A and hereby made a part hereof. <br /> Section 2. That said authority be, and the same is hereby,expressly conditioned as <br /> follows: <br /> (a) That said communication tower be a monopole structure and subject to the terms and <br /> conditions of any agreement to lease or otherwise utilize the property for construction <br /> of said structure; <br /> (b) The lowest eight(8)feet of the facility/tower shall be visually screened by an eight <br /> (8)foot fence; <br /> (c) The facility/tower shall be in compliance with any other applicable local, state,or <br /> federal regulations at all times; <br /> (d) Towers and antennas shall be designed to blend into the surrounding environment <br /> through the use of color and camouflaging architectural treatment, except in instances <br /> where the color is dictated by federal or state authorities such as the Federal Aviation <br /> Administration; <br /> (e) No rungs or other appurtenances used for the purpose of tower access shall be located <br /> within 20 feet of the ground. The owner shall take necessary precautions to prevent <br /> unauthorized access to the tower equipment; <br /> (fl Landscaping will be provided as shown on the approved site plan; . <br /> (g) The proposed tower shall meet the required fall zone; and <br /> (h) All required building permits shall be obtained prior to any construction. <br /> Section 3.
